Live in NY, earn income in AK, do I still pay NY income tax?

July 21, 2010 | Author: | Posted in Home Based Business

I live in NY state. I don’t own property or have a mailing address in my name in NY. My drivers liscense is from NY. I work in Alaska and earn all of my income from Alaska sources. I pay AK unemployment. I spend about 70% of the year in AK.

Do I have to pay NY state income tax and unemployment?

See New York State Publication 80 (General Income Tax Information for New York State Residents) for specific details. Generally speaking, they consider where you are “domiciled,” which they define as “the place you intend to have as your permanent home. Your domicile is, in effect, where your permanent home is located. It is the place you intend to return to after being away (as on vacation abroad, business assignments, educational leave, or military assignment).” (Owning property or having an address in your name do not appear to be relevant. It depends on where you live and how long. The publications provide you thresholds for determining this.) For specific details, see NYS Publication 80 (mentioned above) and NYS Publication 88 (General Tax Information for New York State Nonresidents and Part-Year Residents).

Just curious, if you don’t have a mailing address in NY, why do you have a NY drivers license?
